By accessing or using InsitePilot ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including business clients, their customers, and leads who interact with the platform through forms, SMS, WhatsApp, or other communication channels.
InsitePilot is a customer relationship management (CRM) platform operated by Solutionarian LLC, designed for marketing agencies. The Service includes lead management, client management, appointment scheduling, email campaigns, SMS messaging, WhatsApp messaging, AI chatbot functionality, and related business tools. The Service is provided on an "as-is" and "as-available" basis.
Platform vs. Client Services: InsitePilot serves two roles: (1) as a direct service provider to its registered platform users, and (2) as a software platform that enables individual businesses ("Platform Clients") to manage their own customer relationships, including SMS communications. Each Platform Client operates under its own brand identity and is independently responsible for its customer communications. InsitePilot's own messaging campaigns are entirely separate from those of its Platform Clients.

SMS and WhatsApp communications on the InsitePilot platform are governed by the following terms. There are two distinct categories of messaging:
InsitePilot (operated by Solutionarian LLC) sends SMS notifications and alerts only to its direct platform users — marketing agency clients and their authorized team members — who have opted in to receive such communications. These messages are sent under the InsitePilot registered SMS brand identity and are strictly limited to the following platform-related communications:
Consent & Opt-Out: By providing your phone number and opting in to SMS notifications during signup at insitepilot.com/signup, you consent to receive these platform messages from InsitePilot. Message frequency varies. Standard message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for assistance. SMS consent is not a condition of purchase or account creation. Your mobile information will not be sold to or shared with third parties or affiliates for promotional or marketing purposes.
Individual businesses that use the InsitePilot platform ("Platform Clients") may send SMS and WhatsApp messages to their own customers and leads. These messages are sent under each business's own independently registered SMS brand and campaign — they are not sent by, on behalf of, or under the identity of InsitePilot or Solutionarian LLC.
Each Platform Client is separately registered with The Campaign Registry (TCR) using their own business name, EIN, and brand identity. The consent relationship for these messages is between you and that specific business.
Opting out of one business's messages does not affect messages from other businesses or from InsitePilot platform notifications.
Supported carriers include but are not limited to: AT&T, T-Mobile, Verizon, Sprint, and other major US carriers. For questions about InsitePilot platform messages, contact us at [email protected]. For questions about a specific business's messages, contact that business directly.
You agree not to use the Service to:
Platform Client SMS Compliance: If you are a Platform Client using InsitePilot to send SMS communications, you are independently responsible for: (a) registering your own brand and campaign with The Campaign Registry (TCR), (b) obtaining proper opt-in consent from your message recipients under your own brand identity, (c) complying with all applicable laws including TCPA, CTIA guidelines, and carrier policies, and (d) maintaining accurate opt-out records for your contacts.
You retain ownership of all data and content you submit to the Service, including lead information, contact details, and message content. By using the Service, you grant InsitePilot a limited license to process, store, and transmit your data as necessary to provide the Service.
InsitePilot does not claim ownership of your business data. You are responsible for ensuring that your use of the Service and the data you process complies with all applicable privacy laws and regulations.
The Service integrates with third-party providers including but not limited to Telnyx (for SMS messaging and call tracking), Twilio (for WhatsApp messaging), Amazon Web Services (for email delivery), and other service providers. Your use of these integrations is subject to the respective third-party terms of service. InsitePilot is not responsible for the availability, accuracy, or reliability of third-party services.
Certain features of the Service may require payment. You agree to pay all applicable fees as described at the time of purchase. Messaging costs (SMS) are billed through your Telnyx account, WhatsApp costs through your Twilio account, and are subject to the respective provider's pricing. InsitePilot is not responsible for third-party service charges.
To the maximum extent permitted by law, InsitePilot and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service. Our total liability for any claim arising from these terms shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless InsitePilot, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.
Either party may terminate the use of the Service at any time. We reserve the right to suspend or terminate your account if you violate these terms. Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as required by law or legitimate business purposes.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in Santa Clara County, California.
We reserve the right to update these Terms and Conditions at any time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.
